Troy Ave will not be charged for murder in the Irving Plaza shooting in May that left one man dead and three others (including the rapper) wounded. As reported by _TMZ), a grand jury indicted Troy on second-degree attempted murder and four counts of criminal possession of a weapon. The rapper was arrested on May 27th, following a backstage altercation during a T.I. concert that left his bodyguard, Ronald McPhatter, dead, as well as three others hurt, including the Brooklyn native himself. The arrest came after an 11-second surveillance video appeared to show Troy Ave, gun-in-hand and blood on his leg, firing a single shot in the VIP section of the concert space.

“Nothing in this indictment is a surprise or new,” the rapper’s attorney Scott Leemon told REVOLT in an email confirming the indictment. “It’s the same wrong story that NYPD has been trying to portray. The released video does not show everything nor explain what happened in the VIP room before Troy came running out, as a victim, after he was shot.”

Leemon also stated that he intends to request bail at Troy Ave’s next scheduled court hearing, Wednesday, June 22.

Ave recently released a mixtape, called Free Troy Ave, which was recorded prior to his arrest. In his lyrics and messages throughout the tape, the rapper proclaims his innocence and speaks on the heartbreaking and shocking death of his friend. “You in a better place, but I’m sad and enraged/ Trying not to let tears fall on the page,” he raps on the Intro track titled “Troy Ave Speaks,” which appears to have been recorded over a jailhouse telephone. He later declares his innocence, spitting, “I’m innocent, it ain’t the end, just the beginning/ Innocent, unless they charging me with being real from the very beginning/ That’s a fact, though.”
